(a) A health benefit plan issuer electing to participate in the Healthy Texas Program by offering qualifying group health benefit plans shall file an application with the department to be a participating health benefit plan issuer in a form and manner prescribed by the commissioner.(b) A health benefit plan issuer electing to participate in the program must do so under the terms and conditions of the Insurance Code Chapter 1508 and this subchapter.(c) A participating health benefit plan issuer must offer only qualifying group health benefit plans to small employers participating in the Healthy Texas Program.(d) The commissioner has determined that limitation concerning which health benefit plan issuers may participate in the Healthy Texas Program is necessary to achieve the purposes of the program, and will, in accordance with the Insurance Code §1508.101(c), contract on a competitive procurement basis with one or more health benefit plan issuers to provide qualifying health benefit plan coverage.
