SECTION/RULE §5.9933 - Determining Underserved Areas for Property Owners' Association Insurance

(a) At any time after notice and hearing under Insurance Code §2211.051(b), concerning Establishment of FAIR Plan, whether in response to a petition or on the commissioner's own initiative, the commissioner may issue an order determining that all or part of the designated area is underserved.(b) The order may include a deadline by which FAIR Plan must begin offering property owners' association policies within the underserved area.
