SECTION/RULE §7.1901 - Scope and Applicability

(a) This subchapter applies to any multiple employer welfare arrangement that is subject to Insurance Code Chapter 846, concerning Multiple Employer Welfare Arrangements.(b) This subchapter does not apply to any arrangement or plan that is established or maintained:(1) under one or more agreements that the United States Secretary of Labor finds to be a collective bargaining agreement; or(2) by a rural electric cooperative or a rural telephone cooperative association, as those terms are defined in the Employee Retirement Income Security Act of 1974 (29 United States Code §1002(40)).
