SECTION/RULE §101.391 - Applicability

(a) This division applies to each site in the Houston-Galveston-Brazoria ozone nonattainment area with one or more affected facilities. Affected facilities include vent gas streams, flares, and cooling tower heat exchange systems that emit or have the potential to emit highly reactive volatile organic compounds.(b) For the purpose of compliance with Chapter 115, Subchapter H, Division 1 or 2 of this title (relating to Vent Gas Control; and Cooling Tower Heat Exchange Systems), each site that meets the applicability requirements of this section will always be subject to this division unless exempted under §101.392 of this title (relating to Exemptions).(c) The banking and trading requirements of this division apply to a broker and a broker account.
