SECTION/RULE §117.3000 - Applicability

(a) The provisions of this division (relating to Utility Electric Generation in East and Central Texas) apply to each utility electric power boiler and stationary gas turbine (including duct burners used in turbine exhaust ducts) that:(1) generates electric energy for compensation;(2) is owned or operated by an electric cooperative, independent power producer, municipality, river authority, or public utility, or any of its successors;(3) was placed into service before December 31, 1995; and(4) is located in Atascosa, Bastrop, Bexar, Brazos, Calhoun, Cherokee, Fannin, Fayette, Freestone, Goliad, Gregg, Grimes, Harrison, Henderson, Hood, Hunt, Lamar, Limestone, Marion, McLennan, Milam, Morris, Nueces, Parker, Red River, Robertson, Rusk, Titus, Travis, Victoria, or Wharton County.(b) The provisions of §117.3005 of this title (relating to Gas-Fired Steam Generation) also apply in Palo Pinto County.(c) This division no longer applies in Bexar County after December 31, 2024.
