SECTION/RULE §218.5 - Purpose

The purpose of this subchapter is to regulate brine evaporation pit operations to:(1) prohibit discharge from the facility into or adjacent to water in the state;(2) establish standards for design, construction, location, operation, and maintenance to prevent contamination of surface and groundwater resources;(3) require financial assurance to ensure proper closure of the evaporation pit; and(4) require that the owner or operator submit evidence to the Texas Commission on Environmental Quality of pollution liability insurance coverage of bodily injury and property damage to third parties.
