(a) Centers and facilities operated by federal and Indian tribal governments are not required to be licensed or approved by state or local authorities. The federal agency or Indian tribal government that has oversight of the center or facility must license or approve the center or facility.(b) Emergency shelters and contractors who participate in the at-risk afterschool and outside-school-hours care center programs may be exempt from state licensing requirements. The center or facility must provide sufficient information or documentation to demonstrate that the center or facility is exempt from state licensing.
