(a) The Code, §12.020, which provides for the assessment of administrative penalties, applies to a person who violates the Act or these regulations. Failure to pay an administrative penalty assessed by a final order of the department is a violation of these regulations. Failure to pay a final civil penalty judgment in which express findings of a violation are made and which was entered pursuant to the Act shall also constitute a violation of these regulations.(b) It shall be a violation for a person to distribute restricted-use or state-limited-use pesticides or regulated herbicides without a current pesticide dealer license in accordance with the Act, Subchapter D (relating to Licensing of Dealers).
