(a) Compensation: Livestock that are exposed or infected with a disease as identified in §58.2 of this title (relating to Disease Control) and required to be slaughtered in compliance with §58.31 of this title (relating to Disposal of Diseased or Exposed Livestock) may be subject to compensation from the commission. The executive director will provide the owner with information regarding any available indemnity funds. To the extent possible the commission will assist the owner with accessing, processing and qualifying for any available source of indemnity funds.(b) Availability of Commission Funds: Subject to the availability of funds, the executive director may authorize an indemnity payment for livestock exposed or infected with a disease as identified in §58.2 of this title (relating to Disease Control) and required to be slaughtered in compliance with §58.31 of this title (relating to Disposal of Diseased or Exposed Livestock). In no event will the Commission pay the owner any compensation, which exceeds appraised value, deducting any salvage value and any other indemnity for the livestock.(c) Indemnity Agreement: In order to qualify for compensation from the commission, an indemnity agreement must be signed by the owner and approved for payment by the Executive Director, or designee.
