SECTION/RULE §85.417 - False, Misleading, or Deceptive Advertising

(a) Prohibitions. Advertising that is false, misleading, or deceptive and that directly relates to the making, arranging, or negotiating of a pawn transaction subject to Texas Finance Code, Chapter 371, is prohibited. No advertising may be made under any name that is not on the pawnshop license for the location advertised.(b) Unauthorized advertisers. No person may advertise the availability of pawn transactions or suggest by use of any sign or other advertisement that a location of business is a pawnshop unless that person holds a pawnshop license for that location of business. Use of the words or phrases "loan outlet" or "pawn outlet" constitute prohibited advertising under this subsection. Advertising under a heading, category, or title of "pawnbroker" or "pawnshop" or similar words will constitute prohibited advertising under this subsection if the person does not hold a pawnshop license for that location of business.
